1. Introduction

Welcome to Promerch PPS. These Terms and Conditions govern your use of our website (www.promerchpps.au) and the purchase of any products, kits, or services from Promerch PPS.

By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our website or purchase our goods.

2. Pricing and Payment

All prices listed on our website are in Australian Dollars (AUD) and are inclusive of the applicable Goods and Services Tax (GST) unless stated otherwise.

• We reserve the right to change pricing at any time without notice.
• Payment must be made in full at the time of placing an order.
• We accept payment via Credit Card, PayPal, Afterpay.
• Your order will not be dispatched until payment has cleared.

3. Orders and Delivery

Once an order is placed, you will receive an order confirmation email. We reserve the right to accept or reject any order for any reason, including errors in pricing or product descriptions.

Delivery times provided are estimates only. While we aim to dispatch goods promptly, we are not liable for any delays caused by third-party couriers or circumstances beyond our reasonable control. Risk of loss and title for the goods pass to you upon our delivery to the carrier.

4. Australian Consumer Law (ACL)

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

• to cancel your service contract with us; and
• to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to choose a replacement or refund for a major failure with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion.

You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

5. Warranty Policy & Product Guarantee

In addition to your rights under the ACL, Promerch PPS offers specific manufacturer warranties on our paint protection systems. Promerch PPS comes with a 5-year limited warranty beginning from the vehicle delivery date. This is provided that the installation is performed in accordance with Promerch’s official application guidelines.

Coverage & Requirements

The warranty covers material-related issues only, including:

• No significant yellowing
• No significant fading
• No bubbling or delamination
• No edge lifting
• Guaranteed removability within the warranty period

Warranty Exclusions

This warranty does not cover issues arising from:

• Failure to comply with the above requirements (including DIY applications by non-certified installers).
• Film surface defects caused by the application, including but not limited to dust nibs and orange peel.
• Pre-existing defects on vehicle surfaces before the installation (such as scratches, dents, chips, or paint cracks).
• Stains or scratches that occur after installation, as well as minor scratch marks or loss of gloss resulting from normal aging and wear.
• Improper application environment (such as an unclean spray booth, wrong spray gun settings, or insufficient curing).
• Any damage to the film surface resulting from improper washing methods, the use of automatic car washes, or unsuitable cleaning solutions that may cause abrasion to the film surface.
• Improper use or deviation from company guidelines, including but not limited to physical or chemical damage (such as harsh cleaners, solvents, and alcohol-based products).
• Damage from non-authorized installers or third parties after the installation.
• Water spots caused by mineral deposits that may leave water marks on the paint protection film.
• External damage from collision, accident, vandalism, fire, hail, flood, rust, iron dust, overspray, OEM paint defects, or physical impacts from stones or road debris.
• Damage on non-OEM high-temperature baked paint panels.
• The use of non-Promerch-supplied paint products.
• Applications outside of automotive use.

Liability Limitation

Promerch’s liability under this warranty is limited strictly to the replacement of defective materials. Labor costs associated with reinstallation, vehicle downtime, or consequential damages are not covered. Furthermore, Promerch PPS is not responsible for the workmanship, negligence, or application errors of independent, third-party installers.

6. Intellectual Property

All content on this website, including but not limited to text, graphics, logos, images, videos, and software, is the property of Promerch PPS or its content suppliers and is protected by Australian and international copyright laws. You may not reproduce, distribute, or create derivative works from our content without our express written consent.

7. General Limitation of Liability

To the maximum extent permitted by law, Promerch PPS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your access to or use of, or inability to access or use, our website, goods, or services.

8. Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes arising out of or relating to these Terms will be subject to the exclusive jurisdiction of the courts of that State.
